- Sometimes we reject orders.
- We charge you when we accept your order.
- Weāre not responsible for delays outside our control.

- We have set out in more detail each of the above in the below sections of these Terms.
4. Our Products
- We make childrenswear, particularly, custom designed rompers which are deliberately oversized to allow the product to be worn for longer as your child grows. Please see our Sizing Guide in our FAQs to help you decide the most appropriate size for your child or alternatively you can contact our Customer Care team at Ā info@gingerautumn.com.
- The pictures of our products on our website are for illustrative purposes only. We work to ensure that colours are displayed accurately but we canāt guarantee that a deviceās display of the colours exactly reflects those of our products.
5. Product prices and payment
- The price of our products is inclusive of VAT and will be the price indicated on the order pages when you placed your order. The product price does not include delivery charges and they will be added to your order at the charges relevant to the delivery type you have selected at the checkout page. The delivery options available to you are detailed at the checkout.
- We may from time to time hold promotional offers, sales and discounts (āPromotional Offersā) on products and if this is the case, additional terms may apply to such Promotional Offers. Ā If a Promotional Offer is applied to your order, it will usually only apply to the product price and not the delivery charges unless otherwise expressly stated. Ā Please check the terms of any Promotional Offer carefully before completing your order to make sure you are clear on the terms and happy with them before proceeding.
- We take all reasonable care to ensure that the price of the products advised to you is correct. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting and dispatching your order so that, where the product's correct price at the acceptance date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at the acceptance date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
- We accept payment with Google Pay, Apple Pay and all major credit or debit cards. You must provide your payment details for the products as part of the ordering process, and we will charge you for the products at the point that you place the order. In the event that we do not accept your order or we need to cancel the order, we will refund the price to you.
6. Placing an Order
-
How to place an order.
- We will contact you about your order by email.
- We will first contact you to acknowledge we've received your order.
- We will contact you again if we accept your order which will be when we dispatch the product to you. Ā At this point, a contract for the items in your order is made between you and us.
- It will help us if you can tell us the order number whenever you contact us about your order. The contract which comprises your order and these Terms and Conditions will only be available in the English language.
- Sometimes we reject or cancel orders, for example, because a product is unexpectedly out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because of legal or regulatory changes, or because the product was mispriced or misdescribed by us. When this happens, we let you know as soon as possible and refund any sums you have paid.
-
We may suspend the supply of products to you:
- to deal with technical problems or make minor technical changes;
- to update the product to reflect changes in relevant laws and regulatory requirements; and/or
- make changes to the product as notified by us to you.
-
Restrictions on placing an order
- To order our products, you must be at least 18 years old and be authorised to use the payment method which you use to pay for the products you order. If you are under 18, you may place an order only with involvement of a parent or guardian.
- We provide our products for your personal use only. We may refuse or reject an order if we notice something unusual or suspect that our products are being exploited for any commercial, business or re-sale purpose. If this happens to you and you think we have made a mistake, get in touch with us.Ā
7. Delivery
- There may be limits on the areas to which we delivery for example post code restrictions. For full details of the areas to which we will deliver and timescales see our FAQs for further information. Please check this carefully to ensure we are able to deliver to your area.
- You will be required to select the delivery option you would like, in the checkout pages of the website. Please make sure you have read the terms relating to the various delivery options before you make your selection. As set out above, they can be found at FAQs. Please note if you are buying products during promotional periods, it may take a little longer for our products to be delivered to you. If delivery of the products to you is delayed by an event outside our control (e.g. because of postal/courier delays, logistics or bad weather), weāll let you know as soon as possible.
- Any customs, duties or additional charges which apply to your order will be your responsibility and are not included in the delivery costs.
8. Returns, Cancellations and Defects
- Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract, as set out below. See our Returns Policy for further details.
9. We don't compensate you for all losses caused by us or our products
-
We're responsible for losses you suffer caused by us breaking this contract unless the loss is:
- Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
- Unforeseeable. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
- Caused by a delaying event outside our control. As long as we have taken the steps set out in the section.
- Avoidable. Something you could have avoided by taking reasonable action.
- A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession. We only supply the products for private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you including without limitation any liability for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- We do not limit or exclude liability for any liability that cannot be excluded or limited by law, for breach of your consumer legal rights in relation to the products or Ā for fraud or fraudulent misrepresentation or death or personal injury caused by negligence.
10. Your personal data
- How we use any personal data you give us is set out in our Privacy Notice.
11. Complaints and disputes
- Our complaints policy. Our Customer Care team will do their best to resolve any problems you have with us or our products.
- You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. You and we can also bring a claim in the courts of the country you live in.
12. Other important terms
- We can transfer our contract with you, so that a different organisation is responsible for supplying your product. We'll tell you in writing if this happens and we'll ensure that the transfer won't affect your rights under the contract.
- Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
- We can make changes to this contract. We may make changes to these Terms at any time to reflect changes in the law or for any other reason. The most up-to-date version of our terms will always be displayed on our website so please have a look before placing an order for our products to ensure you know about any changes which may have been made since your last visit to our website.
- If a court invalidates any of these Terms, the rest of the Terms will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
- Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesnāt mean we can't do it later.
